Exemptions For Small Producers: Dollars And Cases

FDA Foods (most packaged items)

  • Small retailer exemption. You may skip Nutrition Facts if your two-year average is under $500,000 in total retail sales to consumers, or under $50,000 in annual sales of foods to consumers. No formal notice required.

  • Small business low-volume path. Not dollar-based. Under 100 full-time employees and under 100,000 units sold per product in 12 months may qualify. Some cases require filing a notice.

  • Reality check. Even if exempt, many retailers and platforms still require a panel. Ask your buyer before you print.

USDA-FSIS Meat and Poultry

  • Major cuts of raw single-ingredient products. Nutrition info is usually required on the package or at the point of purchase.

  • Ground or chopped products. Nutrition labeling is generally required at retail.

  • Limited exceptions. Items sold only to foodservice, shipped for further processing, for export, or custom work can be exempt.
